How We Help With Probate and Trust Administration

Probate and trust administration often bring unexpected challenges. We help personal representatives, trustees, heirs, and beneficiaries manage responsibilities, stay in compliance with Arkansas law, and resolve disputes when they arise. Our goal is to reduce stress, provide clarity, and make sure the process is handled correctly from start to finish.

Probate Administration

When a loved one passes, Arkansas law often requires probate to settle their estate. We represent personal representatives through every stage – from appointment and notices, to asset collection, claims, distributions, and final accounting – ensuring the process is carried out properly and in compliance with Arkansas law.

Will Contests & Estate Disputes

Disputes sometimes arise over the validity of a will or how an estate is being handled. We represent personal representatives, heirs, and beneficiaries in will contests and estate litigation, working to protect rights and ensure the decedent’s wishes are respected.

Small Estate Collection and Distribution

Not every estate requires probate. Arkansas law allows a simplified process for estates valued under $100,000 (after debts). We prepare and file the necessary affidavit and guide distributees through the collection and distribution of assets without a full probate proceeding.

Trust Administration

When a grantor passes away, successor trustees often need legal guidance to carry out their duties. We assist trustees with every step, from trustee acceptance, certification, and notices to beneficiaries, to inventories, accountings, and final distributions. Our role is to ensure the trust is administered correctly and beneficiaries receive their inheritance as intended.

Beneficiary and Heir Representation

Beneficiaries and heirs have rights, but those rights are not always honored during probate or trust administration. We represent heirs and beneficiaries to ensure transparency, hold fiduciaries accountable, and make sure distributions are fair and consistent with the law and governing documents.

Guardianships

When a minor child or incapacitated adult needs protection, a guardianship may be required. We guide families through the process of establishing guardianships, ensuring the vulnerable loved ones receive the care, management, and legal protection they deserve.
