Frequently Asked Questions

Answers to Your Most Common Questions

We know legal matters can be confusing, and questions often come up along the way. That’s why we’ve compiled answers to some of the most common questions we hear from our clients.
What is estate planning, and why should I do it?
Estate planning is making a plan for how your assets will be managed and passed on after you’re gone. It helps make sure your wishes are followed, reduces the chance of family disputes, and can limit estate taxes. Without a plan, state law decides how your estate is divided, which may not match what you want.
What’s the difference between a will and a trust?
A will says how your assets should be distributed after you pass away and usually goes through probate. A trust can manage assets during your life and after, often avoiding probate and giving more control over when and how beneficiaries receive property. Trusts can also add privacy and protection for your estate.
Do I really need a will?
Yes. Without a will, Arkansas’s intestate laws determine how your property is divided, which might not match your wishes. A will gives clear instructions and can help prevent family disputes.
What is probate, and is it always required?
Probate is the legal process for settling someone’s estate after they pass away. It’s usually needed when assets are only in the deceased’s name. Some jointly held assets or accounts with designated beneficiaries can avoid probate. Planning ahead can make the process smoother and less stressful.
How long does probate usually take in Arkansas?
It depends on the size and complexity of the estate and whether disputes arise. Most estates take several months to over a year. Factors like whether there’s a will and how efficiently the executor acts can affect the timeline.
What types of business entities can I form in Arkansas?
You can choose from sole proprietorships, partnerships, LLCs, or corporations. Each option affects liability, taxes, and management rules. The best choice depends on your business goals and situation.
What’s the advantage of forming an LLC over a corporation?
An LLC is flexible and easier to manage than a corporation. It protects your personal assets from business liabilities and allows profits and losses to pass directly to you, often simplifying taxes. Many small business owners prefer this setup.
How can I resolve issues with the IRS?
If you’re facing IRS audits, unpaid taxes, or disputes, a tax attorney can represent you. We can negotiate with the IRS, help you understand your options, and protect your rights. Having a legal expert can make a complex situation much easier to navigate.
Can you help my business stay compliant with state and federal laws?
Yes. We guide business owners through legal requirements, including contracts, formation, and regulatory compliance. Staying on top of the rules can prevent costly disputes and keep your business running smoothly.
